Well, I actually haven't had any progress, I registered the court order with Maintenance Enforcement as recommended and I am now waiting for their agency to do what it is that they do. I have been told that even though a court order may be granted the payee is not actually bond to pay, unless the court order is registered with a court agency that will ensure payment. (Well, whatever payment that the payee has the ability to pay!) If you don't have it registered, it really is only a GOOD FAITH requirement. However, if non-payment is a problem you can register with Maintenance Enforcement at any time and they will attempt to recover whatever arrears there may be. I do have some advice to offer. It may make things much easier for everyone, especially the kids, document everything! Give receipts for payments made, keep a log of all expenses for the kid/s, demonstrate where the money came from to maintain the kid/s expenses when support wasn't paid and always, always keep your receipts to back up your log. These things don't actually take alot time once you are used to doing this, but it will be undeniable proof of what is going on financially when the support is being paid and when it is not!! This has probably been mentioned before, but if not I hope it helps, if made my case proceed much quicker in determining how much support should be paid. Any other advice on how to actually get it to be paid would be helpful!! |
